These terms and conditions (hereinafter the "Terms") set out the rules for using the tarabaseny.com.pl online store available at www.tarabaseny.com.pl (hereinafter the "Store" or "Service").
§1. General provisions

1.2. Definitions
For the purposes of these Terms, the following definitions apply:
- Seller – Patryk Reksa Gold Frieza, operating the online store on the terms set out in these Terms.
- Customer – a natural person with full legal capacity, a legal person, or an organisational unit without legal personality that places an order in the Store.
- Consumer – a Customer who is a natural person making a legal transaction not directly related to their business or professional activity (Art. 22¹ of the Polish Civil Code).
- Entrepreneur – a natural person, legal person, or organisational unit conducting business activity that makes a legal transaction related to their business.
- Store – the online store operated by the Seller at www.tarabaseny.com.pl.
- Goods – a product offered for sale in the Store, in particular swimming pools, pool accessories, and garden equipment.
- Order – the Customer's declaration of intent directed to the Seller, aimed at concluding a Sales Contract.
- Sales Contract – a contract for the sale of Goods concluded between the Seller and the Customer through the Store.
- Price – the consideration for the Goods expressed in Polish zloty (PLN) or euro (EUR), including all components, including VAT.
- Business day – a day from Monday to Friday, excluding public holidays in the Republic of Poland.
1.3. Types of Customers

Consumers – benefit from the full protection provided by Polish and EU law, including:
- The right to withdraw from the contract within 14 days (Art. 27 of the Consumer Rights Act)
- Statutory warranty for defects (Art. 556 et seq. of the Polish Civil Code)
- Protection against unfair market practices (Act on Counteracting Unfair Market Practices)

Entrepreneurs with consumer rights – entrepreneurs who make purchases for purposes unrelated to their business activity benefit from protection on the terms set out in Art. 38a of the Consumer Rights Act.

Entrepreneurs – entities conducting business activity, to which the provisions of the Civil Code concerning sale contracts apply, excluding consumer protection provisions.
§2. Placing orders and the purchasing process
2.1. Conclusion of the contract
- Information about the Goods presented in the Store constitutes an invitation to conclude a contract within the meaning of Art. 71 of the Polish Civil Code.
- Placing an Order by the Customer constitutes an offer to conclude a Sales Contract.
- After placing the Order, the Seller sends the Customer a confirmation of receipt of the offer to the email address provided by the Customer.
- The Sales Contract is concluded at the moment the Seller sends an email confirming acceptance of the Order for processing.
- Each Sales Contract is confirmed by a VAT invoice or fiscal receipt, which are sent electronically to the Customer's email address.
- The language of the contract is English. The contract may also be concluded in Polish if the Store provides a Polish language version.
2.2. Order procedure
- Selecting Goods – the Customer selects Goods by adding them to the cart.
- Cart – the Customer can modify the contents of the cart, remove or add Goods.
- Delivery details – the Customer provides the delivery address for the Goods.
- Selecting the delivery method – the Customer selects a delivery method from the available options (GlobKurier, Furgonetka, DHL, Raben).
- Selecting payment – the Customer selects a payment method (Stripe, Przelewy24, traditional bank transfer).
- Summary – the Customer receives an order summary showing the total amount to be paid.
- Placing the Order – the Customer accepts the Terms and places the Order by clicking "Order and pay".
- Confirmation – the Seller sends a confirmation of acceptance of the Order.
2.3. Minimum order value
- The minimum order value is 50 PLN (for deliveries within Poland) or 15 EUR (for deliveries to EU countries).
- In the case of orders below the minimum value, the Store reserves the right to refuse processing.
2.4. Prices and currencies
- All prices are quoted in Polish zloty (PLN) or euro (EUR).
- The price shown for each Good is binding at the time the Order is placed.
- Prices include VAT at the applicable rate (23% or 8% for selected goods).
- The price does not include delivery costs, which are shown separately during the ordering process.
- The Seller reserves the right to change prices at any time, provided that changes do not affect orders already placed.
- For payments in EUR, the exchange rate is calculated at the National Bank of Poland (NBP) rate on the day the order is placed, plus a 3% margin.
§3. Payments
3.1. Available payment methods

Online payments (instant):
- Stripe – payment cards (Visa, Mastercard, American Express), BLIK, Apple Pay, Google Pay
- Przelewy24 – fast online transfers from most Polish banks

Traditional payment:
- Bank transfer to the Seller's account (details provided after placing the order)

Payments for international orders:
- Stripe (international cards)
- SEPA transfers (for eurozone countries)
3.2. Payment terms

Online payments – are processed immediately after placing the order. Failure to pay within 30 minutes results in cancellation of the order.

Traditional bank transfer – the Customer has 5 business days to make the payment. The order number must be stated in the transfer title. Order processing begins once the payment is credited to the Seller's account.

VAT invoice – is issued automatically after the payment is credited and sent electronically to the email address indicated by the Customer.
3.3. Transaction security
- All payment transactions are processed through secure payment gateways (Stripe, Przelewy24).
- The Seller does not store Customers' payment card details.
- Transactions are encrypted using the SSL/TLS protocol.
§4. Delivery
4.1. Delivery area

- European Union countries – delivery to: Germany, France, Italy, Spain, Netherlands, Belgium, Austria, Czechia, Slovakia, Hungary, Romania, Bulgaria, Croatia, Slovenia, Lithuania, Latvia, Estonia, Finland, Denmark, Sweden, Ireland, Portugal, Greece, Luxembourg

4.3. International deliveries (EU)
Delivery costs to EU countries are calculated individually based on weight, dimensions, and location. When placing an order, the system automatically calculates the delivery cost.

4.4. Heavy deliveries (pools, pallets)
- Bulky goods (pools, large pallets) are delivered by freight companies specialising in heavy transport.
- The delivery cost for heavy goods is calculated individually.
- Delivery of pools and large products requires scheduling a date with the Customer via the carrier.
- The driver contacts the Customer by telephone before delivery.
4.5. Fulfilment time
- Orders are processed within 1-3 business days from:
- Payment being credited (for online payments and bank transfers)
- Order placement (for cash-on-delivery payments)
- In the event of goods being out of stock, the Seller promptly informs the Customer of the expected fulfilment time.
- The maximum fulfilment time is 30 days from the date of contract conclusion.
§5. Returns and withdrawal from the contract
5.1. Right of withdrawal (Consumers)

Pursuant to Art. 27 of the Consumer Rights Act of 30 May 2014 (consolidated text: Journal of Laws 2024, item 1061) and Directive 2011/83/EU, the Consumer has the right to withdraw from the Sales Contract within 14 days from the date of:
- Receiving the Goods
- Receiving the last item of Goods (in the case of a contract for multiple items delivered separately)
- Receiving the last batch or part (in the case of delivery of Goods in parts)

Withdrawal procedure:
- The Consumer submits a declaration of withdrawal from the contract (template available on the Store website: /legal/formularz-odstapienia)
- The declaration may be submitted electronically to: kontakt@tarabaseny.com.pl
- The Consumer may use the withdrawal statement template attached to these Terms

Refund:
- The Seller refunds the Consumer the payment received without undue delay, and no later than 14 days from receipt of the withdrawal declaration
- The refund is made using the same payment method used by the Consumer, unless the Consumer explicitly agreed to a different refund method
- The Seller may withhold the refund until receipt of the Goods or confirmation of their dispatch

Return of Goods:
- The Consumer is obliged to return the Goods without undue delay, and no later than 14 days from the date of withdrawal from the contract
- The Consumer bears the direct costs of returning the Goods
- The Goods should be returned in an unchanged condition, unless the change was necessary due to normal use
- The address to which the product should be returned is determined by the Seller

Exceptions to the right of withdrawal (Art. 38 of the Consumer Rights Act):
- Goods subject to rapid deterioration or with a short shelf life
- Goods delivered in sealed packaging that cannot be opened after delivery due to health or hygiene protection (if opened)
- Goods which, after delivery, due to their nature, are inseparably combined with other items
5.2. Returns for Entrepreneurs
- Entrepreneurs may return Goods only with the Seller's consent and on the terms set out in an individual agreement.
- The right to withdraw from the contract is not available to Entrepreneurs in the course of their business activity.
§6. Claims and statutory warranty
6.1. Statutory warranty for defects (Consumers)
- Pursuant to Art. 556 et seq. of the Polish Civil Code, the Seller is liable to the Consumer for physical or legal defects of the Goods.
- Warranty period: 2 years from the date the Goods are handed over to the Consumer.

- The notification should include: the Customer's contact details, order number, description of the defect, and photos of the defect
- A claim may be filed:
- Response time: the Seller processes the claim within 14 days of receiving a complete notification.
- Remedies:
- Replacement of the Goods with new ones
- Price reduction
- Withdrawal from the contract (refund)
- Repair: if repair or replacement is impossible or would require excessive costs, the Seller may propose an alternative remedy.
6.2. Statutory warranty for Entrepreneurs
- Entrepreneurs benefit from the statutory warranty on the terms set out in the Civil Code, with a period of 1 year.
- Claims from Entrepreneurs are processed within 30 days.
6.3. Additional guarantee
- Selected Goods (frame pools, large products) may be covered by the manufacturer's guarantee.
- The guarantee conditions are set out in the guarantee card included with the Goods.
- The guarantee does not exclude, limit, or suspend the Consumer's rights arising from the statutory warranty.
6.4. Claims procedure
- Step 1: the Customer contacts the Seller and reports the defect.
- Step 2: the Customer returns the Goods to the address indicated by the Seller (at the Seller's expense if the claim is accepted).
- Step 3: the Seller processes the claim and informs the Customer of the outcome.
- Step 4: if the claim is accepted: replacement, repair, or refund.
§7. Personal data protection

Customers' personal data are processed for the purpose of:
- Fulfilling orders (legal basis: Art. 6(1)(b) GDPR)
- Handling claims and returns (legal basis: Art. 6(1)(b) GDPR)
- Fulfilling tax and accounting obligations (legal basis: Art. 6(1)(c) GDPR)
- Direct marketing (legal basis: Art. 6(1)(f) GDPR – legitimate interest)
- Sending newsletters (legal basis: Art. 6(1)(a) GDPR – consent)
7.3. Rights of data subjects
The Customer has the right to:
- Access their personal data
- Rectify data
- Erase data ("right to be forgotten")
- Restrict processing
- Data portability
- Object to processing
- Withdraw consent at any time (without affecting the lawfulness of processing carried out prior to withdrawal)
- Lodge a complaint with the President of the Personal Data Protection Office

8.1. Information about cookies
- The Store uses cookies to ensure the proper functioning of the service, optimisation, and personalisation of content.

§9. Intellectual property
9.1. Copyright
- All content available in the Store (texts, photos, graphics, logo, page layout) is protected by copyright and belongs to the Seller or has been used under appropriate licences.
- Copying, distributing, or using the content without the Seller's consent is prohibited.
9.2. Trademarks
- The name "tarabaseny.com.pl" and all trademarks used in the Store are the property of the Seller.
- Use of the trademarks without the owner's consent is prohibited.
§10. Liability and exclusion of liability
10.1. Seller's liability
- The Seller is liable for non-performance or improper performance of the Sales Contract on the terms set out in legal provisions, in particular the Civil Code.
- The Seller's liability is limited to the value of the order.
10.2. Exclusion of liability
- The Seller is not liable for:
- Interruptions in the operation of the Store resulting from technical reasons (maintenance, failures)
- Damage resulting from improper use of the Goods
- Delivery delays caused by the carrier or circumstances beyond the Seller's control
- Content posted by users in comments and reviews
10.3. External links
- The Store may contain links to external websites. The Seller is not responsible for the content and privacy policy of those websites.
§11. Termination of contract and account blocking
11.1. Termination by the Consumer
- The Consumer may terminate the Sales Contract in the case of:
- Withdrawal from the contract within 14 days (§5 of these Terms)
- Non-performance by the Seller despite setting an additional deadline
11.2. Termination by the Seller
- The Seller may terminate the Sales Contract in the case of:
- Failure to pay within the specified period
- Non-collection of Goods within 14 days of readiness for collection
- Provision of false data by the Customer
11.3. Account blocking
- The Seller may block the Customer's account in the case of:
- Breach of these Terms
- Acting to the detriment of the Store or other Customers
- Repeatedly placing fraudulent orders
- Attempted fraud
- The block is communicated to the Customer electronically.
§12. Final provisions
12.1. Applicable law

Matters not regulated by these Terms are governed by Polish law, in particular:

- Act on the Provision of Electronic Services (consolidated text: Journal of Laws 2024, item 123)

- General Data Protection Regulation (EU) 2016/679 (GDPR)

For Customers from other EU countries, the relevant national provisions implementing EU directives apply.
12.2. Jurisdiction
- Any disputes arising from the Sales Contract shall be resolved by the common courts having jurisdiction over the Seller's registered office.
- Consumers may also use out-of-court methods for resolving complaints and pursuing claims:
- Permanent Consumer Arbitration Court at the President of UOKiK
- Voivodeship Inspectorate of Trade Inspection
12.3. Changes to the Terms
- The Seller reserves the right to change the Terms at any time.
- Changes take effect on the date of their publication in the Store.
- Orders placed before the changes take effect are processed under the terms in force on the date the order was placed.
- The Seller informs Customers of planned changes electronically at least 14 days in advance.
